Welcome to BigChess. These Terms of Use ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User," or "Player") and Big Chess BG Ltd ("Big Chess," "we," "us," or "our"), governing your access to and use of all BigChess products and services, including the BigChess mobile applications for iOS and Android, the web-based game accessible at bigchess10.com, premium physical chess sets sold through our platforms, and all related services, features, content, and functionality (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES. BY CREATING AN ACCOUNT, DOWNLOADING, INSTALLING, ACCESSING, OR USING ANY OF OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
1. Eligibility
1.1. Age Requirements
You must be at least 13 years of age (or the minimum age required in your jurisdiction, such as 16 in certain European Economic Area member states) to create an account and use the Services. If you are between the minimum age and the age of majority in your jurisdiction, you may only use the Services with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
1.2. Parental Responsibility
If you are a parent or legal guardian who has consented to a minor's use of the Services, you are fully responsible for that minor's activities on the Services, including any purchases made, content shared, and compliance with these Terms. You agree to supervise the minor's use of the Services and to be liable for any breach of these Terms by the minor.
1.3. Legal Capacity
By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into this Agreement in your jurisdiction. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
1.4. Geographic Restrictions
The Services are intended for use worldwide, but may not be available in all jurisdictions. You are responsible for ensuring that your use of the Services complies with the laws and regulations of your jurisdiction. We reserve the right to restrict access to the Services from certain geographic locations at our sole discretion.
2. Account Registration and Security
2.1. Account Creation
To access certain features of the Services, you must create a BigChess account. You may register using your email address and a password, or through supported third-party authentication providers such as Google Sign-In or Apple Sign-In. By creating an account, you agree to provide accurate, current, and complete information during the registration process.
2.2. Account Information Accuracy
You agree to maintain and promptly update your account information to keep it accurate, current, and complete at all times. Failure to do so may result in your inability to access the Services or may constitute a breach of these Terms, which could lead to the suspension or termination of your account.
2.3. Account Security
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password and any authentication tokens. You agree to:
- Choose a strong, unique password that you do not use for any other online service.
- Not share your account credentials with any other person.
- Not allow any other person to access or use your account.
- Immediately notify us at info@bigchess10.com if you become aware of or suspect any unauthorized access to or use of your account.
- Log out of your account at the end of each session, especially when using shared or public devices.
2.4. Account Responsibility
You are fully responsible for all activities that occur under your account, whether or not you have authorized such activities. Big Chess BG Ltd will not be liable for any loss, damage, or other consequences arising from unauthorized use of your account that results from your failure to safeguard your credentials.
2.5. One Account Per Person
Each individual is permitted to maintain only one active BigChess account. The creation of multiple accounts by the same person is strictly prohibited and constitutes a violation of these Terms. We reserve the right to detect, merge, or terminate duplicate accounts at our sole discretion. Creating multiple accounts for the purpose of rating manipulation, circumventing bans, or gaining any unfair advantage is grounds for permanent suspension of all associated accounts.
3. License and Use of the Services
3.1. License Grant
Subject to your compliance with these Terms, Big Chess BG Ltd grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install the BigChess mobile application on your personal mobile device(s) for your individual, non-commercial use.
- Access and use the web-based version of BigChess at bigchess10.com through a standard web browser for your individual, non-commercial use.
- Access and use the features and functionality of the Services, including playing chess matches, solving puzzles, viewing leaderboards, and interacting with other users, in accordance with these Terms.
3.2. License Restrictions
The license granted in Section 3.1 is subject to the following restrictions. You agree that you will NOT:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Services, the underlying software, or any part thereof.
- Remove, alter, obscure, or tamper with any copyright notices, trademarks, or other proprietary rights notices contained in or on the Services.
- Use the Services for any commercial purpose without the prior written consent of Big Chess BG Ltd, including but not limited to selling, renting, leasing, or licensing access to the Services or any content derived from the Services.
- Use the Services to develop a competing product or service.
- Access the Services through any automated means, including bots, scrapers, crawlers, or other automated tools, except for standard web browser functionality.
- Distribute, publish, broadcast, or otherwise make available the Services or any content from the Services to any third party without our prior written consent.
- Use any data mining, robots, or similar data gathering or extraction methods on the Services.
- Circumvent, disable, or otherwise interfere with any security-related features of the Services, including features that prevent or restrict use or copying of content or that enforce limitations on use.
- Use the Services in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of the Services.
- Attempt to gain unauthorized access to any part of the Services, other user accounts, or any computer systems or networks connected to the Services.
3.3. Reservation of Rights
All rights not expressly granted to you in these Terms are reserved by Big Chess BG Ltd. Nothing in these Terms shall be construed as granting you any right, title, or interest in the Services beyond the limited license described above.
4. Game Rules, Fair Play, and Sportsmanship
4.1. Game Rules
BigChess is a chess variant played on a 10x10 board with additional pieces and rules unique to the BigChess format. In addition to the core BigChess variant, our applications support other chess game variants with their own specific rulesets. By playing any game on the Services, you agree to abide by the official rules of the specific game variant you are playing, as established by Big Chess BG Ltd and described within the application.
4.2. Fair Play Policy
BigChess is committed to maintaining a fair and enjoyable gaming environment for all players. You agree to the following fair play principles:
- No Computer Assistance: You must not use chess engines, artificial intelligence tools, neural networks, or any other form of computer-assisted analysis to determine your moves during a live game. Each move you make must be your own independent decision.
- No External Help: You must not receive assistance from any other person, whether in person, by phone, through messaging applications, or by any other means, during a live game. All moves must be made independently by the registered account holder.
- No Pre-Arranged Outcomes: You must not collude with another player to predetermine the outcome of a match, including deliberately losing, drawing, or arranging the result of a game for the purpose of rating manipulation or any other reason.
- No Rating Manipulation: You must not engage in any form of rating manipulation, including but not limited to intentionally losing games to lower your rating ("sandbagging"), creating multiple accounts to play against yourself, or any other scheme designed to artificially inflate or deflate any player's rating.
- No Stalling or Time Abuse: You must not intentionally stall, delay moves, or abuse time controls to frustrate your opponent, waste their time, or gain an unfair advantage.
- No Exploiting Bugs: You must not exploit any software bugs, glitches, or vulnerabilities in the game to gain an unfair advantage. If you discover a bug, you are encouraged to report it to us at info@bigchess10.com.
4.3. Anti-Cheat Measures
Big Chess BG Ltd employs automated and manual anti-cheat systems to detect violations of our Fair Play Policy. These systems analyze gameplay patterns, statistical anomalies, move quality, timing data, and other indicators to identify potential cheating. By using the Services, you consent to such analysis of your gameplay data.
If our anti-cheat systems detect a potential violation, your account may be flagged for review. We reserve the right to take any of the following actions, at our sole discretion:
- Issue a warning to your account.
- Temporarily or permanently restrict your access to certain features, such as ranked play or tournaments.
- Adjust, reset, or nullify your ELO rating and/or the results of games determined to have been played unfairly.
- Temporarily suspend your account pending investigation.
- Permanently ban your account from the Services.
4.4. Sportsmanship
We expect all players to conduct themselves with sportsmanship and respect. While competitive play is encouraged, you must treat all opponents, spectators, and community members with courtesy and respect, regardless of the outcome of any game.
5. Prohibited Conduct
In addition to the restrictions described elsewhere in these Terms, you agree that you will NOT engage in any of the following prohibited conduct while using the Services:
5.1. Harassment and Abuse
- Harass, bully, threaten, intimidate, stalk, or abuse any other user or any Big Chess BG Ltd employee, contractor, or representative.
- Send unsolicited, offensive, obscene, vulgar, sexually explicit, hateful, racially or ethnically offensive, or otherwise objectionable messages or content through any communication feature of the Services.
- Engage in targeted abuse, name-calling, or personal attacks against other users in game chat, friend messages, or any other communication channel within the Services.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
5.2. Harmful Content and Activity
- Upload, transmit, or distribute any content that contains viruses, malware, spyware, Trojan horses, worms, or other malicious code.
- Attempt to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Services.
- Engage in any activity that could disrupt, damage, or impair the Services or the experience of other users.
- Use the Services to promote or facilitate any illegal activities, including but not limited to gambling (where prohibited by applicable law), money laundering, or the sale of illegal goods or services.
5.3. Intellectual Property Violations
- Infringe upon the intellectual property rights of Big Chess BG Ltd or any third party, including copyrights, trademarks, patents, trade secrets, and other proprietary rights.
- Use the BigChess name, logo, trademarks, or other branding elements without our prior written consent.
- Stream, record, or redistribute gameplay footage for commercial purposes without our prior written consent. Non-commercial streaming and content creation for personal channels is generally permitted, provided you comply with these Terms and do not misrepresent any affiliation with Big Chess BG Ltd.
5.4. Commercial Exploitation
- Sell, trade, transfer, or offer to sell or trade any BigChess account, in-game items, ratings, or other virtual assets for real-world money or any other consideration.
- Use the Services for unauthorized advertising, promotional materials, spam, junk mail, chain letters, or any other form of unsolicited solicitation.
- Operate, promote, or facilitate any unauthorized tournament, league, or competitive event using the Services for commercial gain without our prior written consent.
6. Intellectual Property Rights
6.1. Our Intellectual Property
The Services, including all content, features, and functionality (including but not limited to all software, source code, object code, algorithms, text, graphics, logos, icons, images, audio, video, user interface designs, game mechanics, board designs, piece designs, animations, data compilations, and the overall look and feel of the Services) are owned by Big Chess BG Ltd, its licensors, or other providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6.2. Trademarks
BigChess, the BigChess logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Big Chess BG Ltd or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
6.3. User Content
You retain ownership of any content you create and submit through the Services, such as chat messages, profile information, and user-generated content ("User Content"). However, by submitting User Content, you grant Big Chess BG Ltd a worldwide, non-exclusive, royalty-free, fully paid-up, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media, format, or channel, whether now known or hereafter developed, in connection with the operation and promotion of the Services.
6.4. Game Data
All game data generated through the use of the Services, including but not limited to match records, move sequences, game outcomes, ELO ratings, statistical data, and replay data, is the property of Big Chess BG Ltd. We grant you a limited, personal, non-commercial license to access and view your own game data through the features provided within the Services, including the ability to export games in PGN format.
6.5. Copyright Complaints
If you believe that any content on the Services infringes your copyright, please notify us at info@bigchess10.com with the following information:
- A description of the copyrighted work that you claim has been infringed.
- A description of the material that you claim is infringing and its location within the Services.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your physical or electronic signature.
7. ELO Rating System and Leaderboards
7.1. Rating System
BigChess uses an ELO-based rating system to measure and track the relative skill levels of players. Your rating is calculated based on your game results against other players, taking into account the rating difference between you and your opponents. Different game variants supported within the Services may maintain separate ratings.
7.2. Rating Accuracy
While we strive to maintain an accurate and fair rating system, your ELO rating is a statistical estimate and may not perfectly reflect your skill level at all times. We reserve the right to adjust, recalculate, or reset ratings at any time, including in cases of detected cheating, rating manipulation, system errors, or significant changes to the rating algorithm.
7.3. Leaderboards
BigChess maintains public leaderboards that display player rankings based on ELO ratings. By using the Services, you agree that your username, display name, rating, and ranking position may be displayed on public leaderboards visible to all users. If you prefer not to appear on public leaderboards, you may contact us to discuss available options.
7.4. Matchmaking
Our matchmaking system automatically pairs players for games based on various factors, including ELO rating, availability, preferred time controls, and other parameters. While we strive to create balanced and fair matches, we cannot guarantee a perfect rating match for every game. By using the matchmaking system, you accept that you may occasionally be paired with opponents whose ratings differ from your own.
8. Spectator and Observer Features
8.1. Spectating Games
The Services may include spectator or observer features that allow users to watch games being played by other users in real time. By playing a game on the Services, you acknowledge and agree that other users may be able to spectate your game. Spectators may view the board position, moves, and related game information.
8.2. Spectator Conduct
If you use the spectator features, you agree to abide by all applicable rules of conduct described in these Terms. You must not use information gained from spectating a game to assist any player currently involved in that game (commonly known as "ghosting"), and doing so constitutes cheating under our Fair Play Policy.
9. Purchases and Payments
9.1. In-App Purchases
The Services may offer certain premium features, content, or virtual items available for purchase within the application ("In-App Purchases"). In-App Purchases made through the iOS application are processed by Apple through the App Store, and In-App Purchases made through the Android application are processed by Google through the Google Play Store. All In-App Purchases are subject to the payment terms, refund policies, and other terms of the applicable app store.
9.2. Premium Physical Chess Sets
Big Chess BG Ltd offers premium physical BigChess chess sets for sale through our website and applications. When you purchase a physical product, the following terms apply:
- Pricing: All prices are displayed in the applicable currency and include or exclude applicable taxes as indicated at the time of purchase. We reserve the right to change prices at any time, but price changes will not affect orders that have already been confirmed.
- Payment: Payment must be made in full at the time of purchase using one of the accepted payment methods. Payment processing is handled by secure third-party payment processors.
- Order Confirmation: After placing an order, you will receive an order confirmation via email. This confirmation does not constitute acceptance of your order. We reserve the right to decline or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraudulent activity.
- Shipping: Shipping times and costs vary depending on your location and the shipping method selected. Estimated delivery times are provided for informational purposes only and are not guaranteed. Risk of loss and title for physical products pass to you upon delivery to the carrier.
- Returns and Refunds: If you receive a defective or damaged product, please contact us at info@bigchess10.com within 14 days of receipt. We will arrange for a replacement or refund at our discretion. Products must be returned in their original condition and packaging. Custom or personalized items may not be eligible for return unless defective.
9.3. Taxes
You are responsible for all applicable taxes, duties, and other governmental charges associated with your purchases, unless otherwise stated at the time of purchase. If we are required to collect taxes on your behalf, the applicable tax amount will be displayed during the checkout process.
9.4. Currency
Prices may be displayed in various currencies depending on your location. Currency conversion, if applicable, is handled by your payment provider and may include additional fees or exchange rate differences that are not controlled by Big Chess BG Ltd.
10. Virtual Items and Digital Content
10.1. Nature of Virtual Items
The Services may include virtual items, digital content, or premium features ("Virtual Items") that can be obtained through gameplay or purchased with real money. Virtual Items have no real-world monetary value and cannot be exchanged for real currency, goods, or services. Virtual Items are licensed to you, not sold, and remain the property of Big Chess BG Ltd.
10.2. No Transfer or Trade
You may not sell, trade, transfer, gift, or otherwise dispose of Virtual Items to any other person or entity, whether for real money or any other consideration. Any attempt to do so is a violation of these Terms and may result in the termination of your account and the forfeiture of all Virtual Items.
10.3. Modification and Removal
We reserve the right to modify, manage, control, or eliminate Virtual Items at our sole discretion, including changing the availability, pricing, or functionality of any Virtual Item. We are not liable to you or any third party for the exercise of such rights.
11. User Communications
11.1. In-Game Chat
The Services may include in-game chat features that allow you to communicate with other players during or after games. You are solely responsible for the content of your communications. All messages sent through the Services are subject to the Prohibited Conduct rules described in Section 5 of these Terms.
11.2. Monitoring
We reserve the right, but have no obligation, to monitor, review, and record user communications within the Services for the purpose of enforcing these Terms, ensuring compliance with our Fair Play Policy, protecting the safety of our users, and complying with applicable laws. We may, at our sole discretion, remove or edit any User Content that violates these Terms or that we find objectionable.
11.3. Reporting
If you encounter any communication or content from another user that you believe violates these Terms, including harassment, abuse, cheating, or other prohibited conduct, you are encouraged to report it through the in-app reporting feature or by contacting us at info@bigchess10.com. We will review all reports and take appropriate action as we deem necessary.
12. Third-Party Services and Links
12.1. Third-Party Integrations
The Services integrate with and rely upon certain third-party services, including but not limited to Firebase Authentication (Google), Apple Sign-In, the Apple App Store, the Google Play Store, and third-party payment processors. Your use of these third-party services is subject to their respective terms of service and privacy policies, which we encourage you to review.
12.2. Third-Party Links
The Services may contain links to third-party websites, applications, or resources that are not owned or controlled by Big Chess BG Ltd. We provide these links solely as a convenience and do not endorse or assume any responsibility for the content, products, services, privacy practices, or policies of any third-party sites or resources. You access third-party links at your own risk.
12.3. No Liability for Third-Party Services
Big Chess BG Ltd is not responsible or liable for any loss, damage, or other adverse consequences arising from your use of or reliance on any third-party services, content, products, or resources accessed through or in connection with the Services.
13. Availability and Modifications to the Services
13.1. Service Availability
We strive to keep the Services available at all times, but we do not guarantee uninterrupted, timely, secure, or error-free access to the Services. The Services may be temporarily unavailable due to scheduled maintenance, unscheduled maintenance, server issues, network disruptions, force majeure events, or other circumstances beyond our reasonable control.
13.2. Modifications
We reserve the right to modify, update, suspend, or discontinue any part of the Services at any time, with or without notice, at our sole discretion. This includes the right to add, remove, or change game features, game variants, rules, game mechanics, user interface elements, and any other aspect of the Services. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.
13.3. Updates
We may from time to time release updates, patches, or new versions of the mobile applications or web platform. You agree to install all required updates promptly. Failure to install required updates may result in the inability to access or use certain features of the Services. Some updates may be installed automatically depending on your device settings.
14. Account Suspension and Termination
14.1. Termination by You
You may terminate your account at any time by contacting us at info@bigchess10.com or by using the account deletion feature within the application settings, if available. Upon termination, your right to use the Services will cease immediately, and your account data will be handled in accordance with our Privacy Policy.
14.2. Suspension or Termination by Us
We reserve the right to suspend or terminate your account and your access to the Services, in whole or in part, at any time and for any reason, including but not limited to:
- Violation of these Terms, including the Fair Play Policy and Prohibited Conduct rules.
- Cheating, use of unauthorized software, or any form of computer-assisted play.
- Harassment, abuse, or threatening behavior toward other users or Big Chess BG Ltd personnel.
- Creation or use of multiple accounts.
- Rating manipulation or collusion with other players.
- Fraudulent activity, including chargebacks or unauthorized payment disputes.
- Extended period of account inactivity (accounts inactive for more than 24 months may be subject to deletion).
- Any conduct that we determine, in our sole discretion, is harmful to other users, Big Chess BG Ltd, or the integrity of the Services.
- Legal or regulatory requirements or requests from law enforcement.
14.3. Effect of Termination
Upon termination or suspension of your account:
- Your license to use the Services is immediately revoked.
- You must cease all use of the Services.
- You lose access to your account, including your game history, ratings, friend lists, and any Virtual Items associated with your account.
- Any pending orders for physical products may be canceled at our discretion.
- We are under no obligation to provide you with a refund for any purchases made prior to termination, except as required by applicable law.
14.4. Appeals
If you believe your account has been suspended or terminated in error, you may submit an appeal by contacting us at info@bigchess10.com. Please provide your username, the reason for your appeal, and any supporting evidence. We will review your appeal and notify you of our decision. Our decision on appeals is final and binding.
14.5. Survival
The following sections of these Terms shall survive termination: Sections 6 (Intellectual Property Rights), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), 18 (Dispute Resolution), and any other provisions that by their nature should survive termination.
15. Disclaimers
15.1. "As Is" and "As Available"
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIG CHESS BG LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
15.2. No Warranty of Availability or Accuracy
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE. WE DO NOT WARRANT THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
15.3. No Warranty for Physical Products
PREMIUM PHYSICAL CHESS SETS ARE PROVIDED "AS IS" SUBJECT TO THE MANUFACTURER'S WARRANTY, IF ANY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO PHYSICAL PRODUCTS. NOTHING IN THESE TERMS SHALL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER UNDER APPLICABLE LAW.
15.4. Beta Features
From time to time, we may offer beta or experimental features within the Services. Such features are provided "as is" without any warranty and may contain bugs, errors, or other issues. We may modify or discontinue beta features at any time without notice.
16. Limitation of Liability
16.1. Exclusion of Certain Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIG CHESS BG LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
16.2. Aggregate Liability Cap
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF BIG CHESS BG LTD AND ITS AFFILIATES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO BIG CHESS BG LTD IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
16.3. Basis of the Bargain
You acknowledge and agree that the disclaimers and limitations of liability set forth in these Terms reflect a reasonable and fair allocation of risk between you and Big Chess BG Ltd, and that these limitations form an essential basis of the bargain between you and Big Chess BG Ltd. Big Chess BG Ltd would not be able to provide the Services to you on an economically reasonable basis without these limitations.
16.4. Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. In such jurisdictions, our liability and warranties shall be limited to the fullest extent permitted by applicable law. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded or limited.
17. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Big Chess BG Ltd, its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your use of or access to the Services.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or third-party right.
- Any User Content you submit, post, or transmit through the Services.
- Your interaction with any other user of the Services.
- Any dispute between you and any third party arising from your use of the Services.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
18. Dispute Resolution

We will attempt to resolve the dispute through good-faith negotiations for a period of at least 30 days from the date we receive your written notice of the dispute.
18.2. Governing Law
These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Big Chess BG Ltd is incorporated, without regard to its conflict of law provisions.
18.3. Jurisdiction
If informal resolution is not successful, any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of competent jurisdiction in the location of Big Chess BG Ltd's registered office, and you hereby consent to the personal jurisdiction and venue of such courts.
18.4. Exceptions
Nothing in this Section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or other proprietary rights.
18.5. Consumer Rights
If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction that provides mandatory consumer protections, nothing in these Terms shall deprive you of the protections granted to you by the mandatory provisions of the laws of your country of residence. In particular, any dispute resolution provisions in these Terms shall not prevent you from bringing proceedings before the courts of your country of residence if permitted by applicable law.
19. General Provisions
19.1. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices or agreements published by Big Chess BG Ltd on or through the Services, constitute the entire agreement between you and Big Chess BG Ltd concerning your use of the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
19.2. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

The failure of Big Chess BG Ltd to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any right or provision shall only be effective if made in writing and signed by an authorized representative of Big Chess BG Ltd. No single or partial exercise of any right or remedy shall preclude any other or further exercise of such right or remedy.
19.4. Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without the prior written consent of Big Chess BG Ltd. Big Chess BG Ltd may assign, transfer, or sublicense its rights and obligations under these Terms without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
19.5. Force Majeure
Big Chess BG Ltd shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, government actions, power failures, Internet or telecommunications failures, cyberattacks, or any other force majeure event.
19.6. Notices
We may send you notices and communications regarding the Services by email to the address associated with your account, by push notification to your mobile device, by in-app notification, or by posting a notice on our website. You are responsible for keeping your email address up to date. Notices sent by email are considered received upon sending, and notices posted on the website are considered effective upon posting.
19.7. No Third-Party Beneficiaries
These Terms are between you and Big Chess BG Ltd. No third party shall have any rights or benefits under these Terms, and no third party is intended to be a beneficiary of these Terms.

23. Apple-Specific Terms (iOS Users)
If you access the Services through the BigChess iOS application downloaded from the Apple App Store, the following additional terms apply:
- These Terms are between you and Big Chess BG Ltd only, and not with Apple Inc. ("Apple"). Big Chess BG Ltd, not Apple, is solely responsible for the BigChess application and its content.
- Your use of the BigChess application must comply with the Apple App Store Terms of Service.
- Big Chess BG Ltd, not Apple, is responsible for providing any maintenance and support services for the BigChess application.
- In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the application.
- Big Chess BG Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the application, including but not limited to product liability claims, claims that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, Big Chess BG Ltd, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms (with respect to this section), and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
24. Google Play-Specific Terms (Android Users)
If you access the Services through the BigChess Android application downloaded from the Google Play Store, the following additional terms apply:
- These Terms are between you and Big Chess BG Ltd only, and not with Google LLC ("Google") or any of its affiliates. Big Chess BG Ltd, not Google, is solely responsible for the BigChess application and its content.
- Your use of the BigChess application must comply with the Google Play Terms of Service.
- Google is not responsible for providing any maintenance, support, or warranty services for the BigChess application.
- Google is not responsible for addressing any claims by you or any third party relating to the application.
